In case of non-notification in the Register of Foreign Operations in Denmark, or if the driver is unable to present the necessary documentation, the Danish Road Traffic Authority and the police have the option of issuing fines to the companies. The guideline for the fine rate for missing or incomplete notification in the Register for Foreign Opera- tions in Denmark before the transport begins is DKK 10,000, which is charged to the company. The guideline for the fine rate for violation of the remuneration requirement is DKK 35,000, which is charged to the company. New rules apply to carrying out freight cabotage, bus cabotage and the road leg of combined transport in Denmark As of 1 January 2021, the rules for remuneration of posted drivers must be applied when companies carry out cabotage with goods where the total permissible weight of the motor vehicle or lorry exceeds 3,500 kg, bus cabotage or the road leg of combined transport in Denmark. What is the company obligated to do? Remuneration of the driver A company must remunerate drivers according to a minimum hourly rate for driving when carrying out cabotage, bus cabotage or the road leg of combined transport takes place in Denmark. The hourly rate for remuneration of drivers who carry out cabotage with goods or the road leg of combined transport currently amounts to a minimum of DKK 168.56 as at 1 March 2021. The hourly rate for remuneration of drivers who carry out bus cabotage driving currently amounts to a minimum of DKK 168.31 as at 1 March 2021. The hourly rate for remuneration of drivers who carry out tourist driving currently amounts to a mini- mum of DKK 173.65 as at 1 March 2021. The rates are updated at least once a year. Registration of the transport At the latest at the same time as the transport begins, the individual company must notify the follow- ing to the Danish Business Authority via the Register of Foreign Operations in Denmark: 1) Company name, business address and contact information. 2) Information on mode of transport. 3) Registration number of the towing vehicle. 4) Date of commencement and end of transport. 5) The identity and contact details of the drivers carrying out the transport in question. 6) The type of transport carried out. Registration of transport is done by using the Danish Business Authority’s online solution, Register of Foreign Operations in Denmark, which can be found on www.virk.dk. Documentation requirements The company’s driver, when inspection takes place at the roadside, must, on request, present the following documentation to the police or the Danish Road Traffic Authority: 1) Notification in the Register of Foreign Operations in Denmark. 2) Employment contract for the driver. 3) Pay slips or other documentation with equivalent information, where it is possible to see the method for calculating the remuneration for the transport, for the periods during which the driver of the company in question has, within the past year, carried out cabotage with goods, bus cabotage or combined transport . 4) Working hours calculation for the driver or other equivalent documentation for the same period as the documentation for remuneration and proof of remuneration payment. 5) Freight documents, transport contracts or control documents for the same period as documen- tation for remuneration. Supervision The Danish Road Traffic Authority, in collaboration with the police, supervises that the requirements for registration of the transport and the remuneration requirement are complied with from 1 January 2021. This means that both the Danish Road Traffic Authority and the police will be present on the road to carry out inspections at the roadside.
